What is DWI/DUI in New Jersey?

• For adults, a DWI or DUI in New Jersey means operating a motor vehicle or a powerboat with a blood alcohol concentration (BAC) of .08% or higher.
• 21-years or younger.  For drivers under the age of 21, anything above .01% qualifies as DUI. This is a per se rule, meaning that a driver under the age of 21 can be charged and convicted even if there is no evidence that the person's ability to drive was actually impaired.
• Commercial drivers under 21-years.  Truck drivers 21-years or younger can be charged with DWI/DUI for a BAC result of.04% 

 

BAC levels are typically established by chemical testing of a driver’s blood and breath.  The holder of a New Jersey driver's license already has consented to having this test performed if police have probable cause that you are intoxicated.  Under New Jerey law, the refusal to consent to testing is a criminal offense independent of the DWI/DUI charge, which results in fines, license suspension and other DUI consequences. These charges can stand even if you are not ultimately convicted of DUI.
