What is DWI/DUI in New Jersey?

• For adults, a DWI or DUI in New Jersey means operating a motor vehicle or a powerboat with a blood alcohol concentration (BAC) of .08% or higher.
• 21 years or younger.  For drivers under the age of 21, anything above .01% qualifies as DUI. This is a per se rule, meaning that a driver under the age of 21 can be charged and convicted even if there is no evidence that the person's ability to drive was truly impaired.
• Commercial drivers under 21-years.  Truck drivers 21 years or younger can be charged with DWI/DUI for a BAC result of .04% 

 

BAC levels are typically established by chemical testing of a driver’s blood or breath. The holder of a New Jersey driver's license already has consented to the test if police have probable cause that you are intoxicated.  Under New Jersey law, refusal to consent to testing is a criminal offense independent of the DWI/DUI charge, which results in fines, license suspension, and other DUI consequences. These charges can stand even if you are not ultimately convicted of DUI.
