What is DWI/DUI in New Jersey?
- For adults, a DWI or DUI in New Jersey means operating a motor vehicle or a powerboat with a blood alcohol concentration (BAC) of .08% or higher.
- 21 years or younger. For drivers under the age of 21, anything above .01% qualifies as DUI. This is a per se rule, meaning that a driver under the age of 21 can be charged and convicted even if there is no evidence that the person's ability to drive was truly impaired.
- Commercial drivers under 21-years. Truck drivers 21 years or younger can be charged with DWI/DUI for a BAC result of .04%
BAC levels are typically established by chemical testing of a driver’s blood or breath.
