Section 39:4-97 - Careless Driving

N.J.S.A. 39:4-97 defines careless driving as “a person who drives a vehicle carelessly, or without due caution and circumspection, in a manner so as to endanger, or be likely to endanger, a person or property, shall be guilty of careless driving.”  A person convicted of careless driving will receive a 2-point violation. 

Careless driving tickets are typically issued when a driver operates a vehicle in an aggressive manner or in such a manner as disregarding the care and safety of others.  Examples include frequent lane changing or weaving in and out of traffic, texting while driving or using a handheld mobile phone while driving, driving with excessive speed, failure to yield, and disregarding traffic signs.
